What Should You Do (or Not Do) in a DUI Arrest?

  1. Do not make statements to the police. You have probably heard police on TV shows say “you have the right to remain silent” hundreds of times. However, if you are pulled over by the Castle Rock police, it really is important to follow this advice. You should be polite and compliant with the officer, but try to respond to their questions with nods and behaviors, not words. Provide the officer with your license and registration as requested, but do not answer their questions out loud. If you do say something, the officer could state in their report that your speech was slurred or otherwise affected by alcohol, even if you were not impaired by alcohol. You may feel that you want to be compliant and tell the officer that you had just one drink, but this actually can be used as evidence that you were impaired while driving. Whenever possible, it is best to just remain silent.
  2. Consult an experienced DUI lawyer as soon as possible. They can give you advice right away about things you can be doing to help your case. If you hire an attorney, it can take weeks for them to obtain the evidence from the prosecution. It also takes time for your attorney to review video from your arrest. For all these reasons, it’s best to get that process started as early as possible so your case won’t be unnecessarily delayed or negatively affected.
  3. Be sure to request a DMV hearing right away. If you took a breath test or refused to do any BAC test, you have 7 days from your arrest to request this hearing. If you had a blood test done, you must request the DMV hearing within 7 days of getting those results (which can take months). Why is the DMV hearing important for your criminal case, if they are not directly related to each other? Your attorney can question the officer about the details of your case at the DMV hearing, to gather a preview of what they would say in the criminal proceedings, and find potential issues in their testimony to help your case. When you request the hearing, you should choose the option to have the arresting officer to be present at the hearing. Furthermore, if the police officer fails to show up at the hearing, you will win the DMV hearing automatically. And, of course this hearing gives you the chance to possibly keep your driver’s license, which is critical for most people in Castle Rock.
  4. Do not plead guilty, admit guilt, or assume that you will be found guilty. In most cases, there is evidence that can, at the minimum, help to reduce the penalties against you, and in some cases can even lead to charges being dismissed.
